Both NSW Police and Victoria Police say using an electronic device, such as an Apple Watch or Android Wear watch, while driving could result in fines.

"Driving is a complex task that requires full concentration and it's essential that drivers minimise the risk of distraction in their vehicle," Victoria Police said in a statement to Fairfax Media.

"Anyone caught using mobile phones, GPS or other electronic devices while driving could face penalties."

Victoria Police added: "[Drivers] don't have to take the watch off as long as the driver has full concentration on the road."

This would mean that, according to Victoria Police, you can keep the watch on while driving but not take calls on it or touch it to do tasks like check text messages and tweets.

Meanwhile, NSW Police would not say whether drivers should take off their smartwatches before getting behind the wheel.

But the state policing agency did say drivers should keep their eyes on the road, not their smartwatch.

"It is important that drivers are not distracted by any device whilst driving which creates a danger to themselves and other road users," NSW Police said.

"It is an offence to not have proper control of your vehicle or to drive negligently as a result of being distracted by the use of any device whilst driving."

South Australia Police also appear to have taken the view that using a smartwatch while driving is illegal.
