“You could have killed someone. You could have killed yourself,” Magistrate Brian Van Zuylen told a Charnwood, ACT man in Queanbeyan Local Court on Monday.

Brodie Antoniak, 28, pleaded guilty to high-range drink driving and two counts of not complying with the conditions of his licence.
Magistrate Van Zuylen said that Antoniak had come under notice of police on November 14 after he collided with a parked car in Majors Creek. He was breath tested and produced a result of .160, three times over the legal limit.
The court was told that the apprentice tiler had been with friends on the day of the offence at Majors Creek. He then made the wrong decision by attempting to drive home after consuming alcohol.
Antoniak had previously faced court in February, 2009 for a blood alcohol offence and was placed on a restricted licence to get to and from work, which Magistrate Van Zuylen said he had “completely ignored”.
The court was told that Antoniak acknowledged he abused the trust of the magistrate who allowed him to have a restricted licence.
Magistrate Van Zuylen said Antoniak faced possible imprisonment because it was his second offence.
Antoniak was sentenced to eight months imprisonment, which was suspended under Section 12.
“If you commit any offence whatsoever, you go to prison,” Magistrate Van Zuylen said.
Antoniak was also disqualified from driving for five years with the opportunity of a reduction to two years if he participated in the driver interlock program.
The offender was also ordered to pay $300 for both counts of not complying with his licence and court costs totalling $228.
